I'm still a bit confused at the issue but let me take a shot. Fair Use is the ability to share ideas of others with breaking the law. I believe that fair use is a component that goes along with Free Speech.
Your on to a good start with that definition but it does go way deeper than that. You are an artist and you've worked hard to make it up and out to get yourself known. You finally get a few songs that make you tons of money. As we know each time the song is played somewhere or used you make money.
I like your songs and I have skills and want to make it big also. So without your permission I use one of your songs, with some tweaks and changes in a commercial. I now make big make big money.
Would you have a problem with it or would it be okay with you? Sometimes both sides have a valid point but it's getting rough to tell where you draw the line.
